Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Sean Cousins, a sole trader based in the United Kingdom and trading as "LifePins" ("we", "us", "our"). They govern your access to and use of the LifePins website and application (together, the "Service").
1. Acceptance
By creating an account or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Service. You confirm that you are at least 16 years old, or, if you are using the Service on behalf of an organisation, that you have authority to bind that organisation.
2. The Service
LifePins is a private mapping and journaling tool that lets you pin photos and memories to a 3D globe and a map, and optionally share those memories with members of your family group. We may add, change or remove features from time to time.
3. Your account
- You must provide accurate information when you register and keep it up to date.
- You are responsible for keeping your account credentials confidential and for all activity under your account.
- You must notify us promptly if you suspect any unauthorised access.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent or abusive purpose;
- upload content that infringes intellectual property rights, is defamatory, harassing, hateful, or sexually exploitative of any person;
- upload malware or attempt to probe, scan, scrape, or interfere with the security or integrity of the Service;
- attempt to reverse engineer, decompile or circumvent any technical limits of the Service;
- resell, sublicense or redistribute the Service without our written consent.
5. Your content
You retain all rights in the photos, captions, location data and other content you add to LifePins ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display and back up Your Content solely as needed to provide the Service to you and the family members you invite. You are responsible for Your Content and for having the rights to share it.
6. Intellectual property
We and our licensors retain all right, title and interest in and to the Service, including all software, designs, trademarks and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes within your chosen plan.
7. Plans, payment and Merchant of Record
LifePins offers a free plan (up to 4 family members and 100 memories per family) and a paid "Family Plus" plan (unlimited members and unlimited memories) billed at £1 per month or £10 per year per family.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.Payment, billing, taxes, cancellations and refund mechanics are governed by Paddle's Checkout / Buyer Terms.
Paid subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time through your account or through paddle.net; cancellation takes effect at the end of the current paid period and you keep access to Family Plus until that date.
8. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if you materially breach these Terms, if your payment fails, if there is a security or fraud risk, or if we are required to do so by law. You may close your account at any time. On termination, your access to the Service ends and we will delete or anonymise Your Content in accordance with our Privacy Notice.
9. Service level and warranties
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error- free, or that any defects will be corrected. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the fees you paid to us (via Paddle) for the Service during that period. Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify and hold us harmless from any claims, losses or damages (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your unlawful use of the Service.
12. Changes
We may update these Terms from time to time. We will post the updated version on this page and, where the changes are material, give you notice by email or in-app. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except where mandatory consumer protection rules in your country of residence give you the right to bring proceedings locally.
